Disclaimer on Public Driving Permits 

  1. Waxd is not responsible for verifying, issuing, or ensuring the validity of any taxi driver's Public Driving Permit (PDP). It is the sole responsibility of each taxi driver to obtain, maintain, and comply with all requirements for a valid PDP in accordance with applicable South African laws and regulations, including those set forth by the National Road Traffic Act. Waxd disclaims any and all liability, including but not limited to claims, damages, or losses, arising from a driver's failure to hold a valid PDP or from any related incidents, accidents, or legal proceedings.

                                                           PERSONAL INFORMATION POLICY

  1. Waxd is committed to protecting your privacy and Personal Information when you use our Website, purchase a Taxi Ticket, or access our App. We implement business practices that comply with relevant legislation, including the Protection of Personal Information Act 4 of 2013 (“POPIA”). This policy explains how we collect, use, and protect your Personal Information.

  2. Personal Information includes your full name, surname, email address, identity number, contact details, location data, and biometric information (such as fingerprints, voiceprints, retinal or iris scans, facial geometry, or other unique biological patterns).

  3. We collect, store, and use the following types of information: 

    • Your first name(s), surname, address, phone numbers, email address, IP address, cookie data, location information, demographic details (including age and gender), health-related information, unique biological patterns, browser details (e.g., hardware model, operating system version, unique device identifiers), and transaction details. 

    • This information is necessary to fulfill our obligations under our agreement with you when you purchase or use our Services.

  4. We collect information from the following sources: 

    • Directly from you when you sign up for Waxd’s Services. 

    • Your devices (e.g., computers, mobile phones, tablets) when you interact with our Website, App, or Services. 

    • Other sources, including: 

    • Online advertising and third-party analytics companies. 

    • Credit reference agencies, identity verification agencies, and service providers for identity verification, credit checks, and fraud detection. 

    • Third-party service providers that support our operations and enable us to deliver Services. 

    • Credit bureaus and financial institutions. 

    • Publicly available sources (e.g., public records of criminal convictions or arrests).

  5. We use your information to deliver our Services and manage our relationship with you. For example: 

    • We may collect and store location data by converting your IP address or mobile GPS data into approximate geo-locations to improve and personalize Services. 

    • We record your location during payment transactions. 

    • You can configure your browser to refuse cookies, but this may limit App functionality or access to promotions. Note that third-party advertisers on our App may use their own cookies, over which we have no control or responsibility.

  6. We process only adequate and relevant Personal Information for the following purposes: 

    • Providing Services as outlined in our T&Cs. 

    • Operating and managing your Member / Commuter / Driver Account. 

    • Monitoring and analyzing our business operations. 

    • Contacting you via email, SMS, or other means about our products and services (you may opt out at any time). 

    • Developing a personalized view of you to identify, create, or enhance relevant products. 

    • Conducting market research, business analysis, and statistical studies. 

    • Performing audits and administrative tasks, such as testing processes and systems. 

    • Complying with regulatory obligations. 

    • Enabling our service providers to assist us in delivering Services to you.

  7. Your information is used for: 

    • General contracting purposes. 

    • Enabling secure, compliant payments. 

    • Facilitating our Cashless Payment System and other products/services. 

    • Responding to your requests for information, products, or services. 

    • Customizing content. 

    • Communicating new offers. 

    • Internal reporting and development. 

    • Any other purpose with your permission, as permitted or required by law, or in the public interest.

  8. We may aggregate your data with that of other users to analyze usage patterns, improve Services, and share statistical insights with partners to enhance user experiences.

  9. We and our service providers may collect biometric data (e.g., fingerprints or voiceprints) for identity verification, which may be shared with regulators or as required by law.

  10. Waxd strives to keep your information accurate and current. You may request corrections or deletions of inaccurate information by emailing support@waxd.com.

  11. You may object to our use of your information on reasonable grounds by contacting us directly. We will cease use unless permitted by law.

  12. If you believe we are using your information unlawfully, you may file a complaint with the Information Regulator. Contact details are available in our PAIA manual (accessible [here](link-to-PAIA-manual)). [Note: Upload PAIA manuals and forms to the Website and link to them for PI requests.]

  13. We do not intentionally collect or process information from children (under 18 years) without consent from a competent person (e.g., parent or guardian).

  14. Your Personal Information is kept confidential and shared only as per this Policy, with your consent, or as required by law. Our third-party service providers are contractually obligated to secure your data and use it only as we direct.

  15. We employ appropriate technical and organizational measures to safeguard your information, including firewalls, data encryption, and access controls (electronic and physical). Access is limited to employees who need it for their roles.

  16. We retain Personal Information only as required by law or for legitimate business purposes, and only for the reasons stated in this Policy. De-identified data may be retained indefinitely for statistical analysis.

SECTION 43 DISCLOSURE IN TERMS OF THE ELECTRONIC COMMUNICATION AND TRANSACTIONS ACT 25 OF 2002 (ECT ACT)

  1. Data Messages (as defined in the ECT Act) are deemed received by Waxd upon our response.

  2. Data Messages from us are deemed received by you per section 23(b) of the ECT Act.

  3. Electronic signatures, encryption, or authentication are not required for valid communications between us.

  4. You warrant that Data Messages sent from your devices are authorized by you.
